Finality: Supreme Court fixes date for judgement on presidential polls – Atiku, Obi, Tinubu to know fate

The infallibility of the Supreme Court of Nigeria will manifest on Thursday October 26, 2023,

when it gives judgement in the cases of Labour Party and its presidential candidate, Peter Obi; the Peoples Democratic Party (PDP) and its candidate, Atiku Abubakar and the All Progressives Congress (APC) and its candidate, Bola Tinubu.

Contrary to expectations, the announced judgement date is coming barely 72 hours after a seven-member panel of the court headed by Justice Inyang Okoro, heard the appeals and reserved its verdict after parties in the matter adopted their final briefs of argument.

Atiku, Tinubu and Obi

Atiku and Obi are challenging the declaration by the Independent National Electoral Commission, INEC, that Tinubu of the ruling All Progressives Congress, APC, was the valid winner of the presidential election held on February 25.

They are praying the apex court to set aside the September 6 judgment of the Presidential Election Petition Court, PEPC, which dismissed their allegation that the election was rigged in favour of the ruling party.

Aside from challenging President Tinubu’s eligibility to participate in the contest, Atiku, who came second, and Obi who came third, maintained that Tinubu did not secure the majority of valid votes that were cast during the election to be declared the winner.

The late supreme Court Judge, Hon. Justice Chukwudifu Akunne Oputa, J.S.C. had said, “We are final not because we are infallible; rather we are infallible because we are final.”
